Bender comments on State Bar investigation

Paul Bender, professor and dean emeritus at the College of Law, was quoted in an article titled, “State Bar investigates Attorney General Tom Horne,” in The Arizona Republic on Dec. 3.

The State Bar of Arizona’s accusations against Horne stem from a 14-month investigation into alleged campaign finance violations. The investigation includes findings from both the election-related investigation and Horne’s role in a March hit-and-run incident.

Bender told reporter Yvonne Wingett Sanchez that Horne, if disbarred, could argue state statutes are unconstitutional because they place conditions on who can serve as attorney general.

Bender has argued more than 20 cases before the U.S. Supreme Court, and actively participates in constitutional litigation in federal and state courts. He also teaches courses on U.S. and Arizona constitutional law, and has written extensively about constitutional law, intellectual property and Indian law.
